Terms of Service for "Gemseek" Mobile Application

1. Acceptance of Terms

By downloading, installing or using the mobile application "Gemseek" (hereinafter referred to as "the Application"), you accept these Terms of Service without reservation. If you do not accept these conditions, please do not use the Application.

2. Minimum Age

The use of the Application is reserved for persons aged 16 years or older. We reserve the right to suspend or delete any account if the user is suspected of being a minor.

3. Account Creation and Management

• Unique Account: Each user is authorized to create only one account. Possession of multiple accounts may result in the deletion of all associated accounts without prior notice.
• Accuracy of Information: You agree to provide accurate and current information when creating your account and to update it regularly.
• Confidentiality of Identifiers: You are responsible for the confidentiality of your login identifiers and all activities performed under your account. Do not share your password with anyone, regardless of the origin of the request.

4. Profile Content

Your profile is intended to use the application, create content, share and discuss online. In this regard, you agree to:

• Not provide false information.
• Not publish descriptions of a sexual, obscene, or discriminatory nature.
• Not include commercial content aimed at selling a product or recruiting clients or partners.
• Not share links to external sites without prior authorization.

5. Profile Photos

By uploading photos to the Application, you agree to:

• Publish only personal photos where you are clearly recognizable.
• Not publish photos of third parties without their explicit consent.
• Not share photos containing nudity, weapons, or inappropriate content.
• Not include photos displaying personal information such as email addresses, phone numbers, or links to other websites.

6. Code of Conduct

By using the Application, you agree to:

• Respect the privacy of other users by not sharing their information without their consent.
• Do not enter private properties or places forbidden to the public.
• Do not venture into dangerous areas (cliffs, rivers, abandoned buildings, unsecured areas, etc.).
• Do not make defamatory, insulting, racist, discriminatory or threatening remarks.
• Do not solicit other members for commercial purposes or to direct them to external sites.
• Be insured and properly equipped for any outing.

8. Intellectual Property

All contents available on the Application, including texts, images, logos, and trademarks, are protected by the laws in force on intellectual property. Any unauthorized reproduction, distribution, or use of these contents is strictly prohibited.

By publishing content on the Application, you grant Gemseek a non-exclusive, free, and worldwide right to use, reproduce, modify, adapt, publish, and distribute such content for promotional and communication purposes, including on the Application's social media channels (for example, Gemseek's Instagram page). When your content is used, Gemseek endeavors to include a thank you mention with your username or Instagram page in the credits, when possible. This authorization is granted for the entire duration of protection of your intellectual property rights.

9. Limitation of Liability

The Application is provided "as is" without any express or implied warranty. We cannot guarantee that the Application will be free of errors or interruptions. In no event shall we be liable for direct or indirect damages resulting from the use or inability to use the Application.

10. Terms Modifications

We reserve the right to modify these Terms of Service at any time. Modifications will take effect upon publication on the Application. It is your responsibility to regularly check the Terms of Service to be informed of any changes.

11. Termination

We reserve the right to suspend or delete your account in case of violation of these Terms of Service or inappropriate behavior. You can also choose to delete your account at any time through the Application settings.

By registering on the Application, you agree to receive advertisements from Gemseek and its partners.
